These Terms of Service ("Terms") govern your use of the Sneaky Cards website at sneakycards.com (the "Site") and the related card tracking, account, and card-design services (collectively, the "Service"). The Service is operated by Cody Borst ("we", "us", "Sneaky Cards"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance and changes
These Terms form a binding agreement between you and Sneaky Cards. We may update them from time to time. Material changes (anything that affects your rights or obligations) will be announced to account holders by email at least 14 days before they take effect; non-material changes (typos, clarifications) may be applied silently. The "last updated" date at the top of this page is authoritative. Your continued use of the Service after a change becomes effective is your acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years old to create an account (16 in jurisdictions where 16 is the minimum digital-service consent age). If you are under the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed these Terms with you and consented to your use of the Service.
3. Accounts
- You are responsible for keeping your sign-in credentials confidential. Don't share your password. Sneaky Cards staff will never ask for your password by email.
- You are responsible for any activity that takes place under your account, including any tracking events or comments logged from it.
- Provide accurate information. Don't impersonate another person, organization, or brand.
- You may close your account at any time from account settings. We may suspend or terminate your account if you materially violate these Terms (see § 10).
4. User content and community standards
"User Content" means anything you submit to the Service, including but not limited to deck registrations, tracking events (including approximate geolocation), and comments on tracking pages.
You retain ownership of User Content you create. By submitting User Content you grant Sneaky Cards a worldwide, royalty-free, non-exclusive, sub-licensable license to host, store, reproduce, modify (for formatting), publicly display, and distribute that content for the purpose of operating and improving the Service. The license ends when you delete the User Content or close your account, except for backup copies retained for a reasonable period and for content that has been shared with other users (which may persist in their views).
Don't submit User Content that:
- Harasses, threatens, defames, dehumanizes, or sexually targets another person.
- Reveals another person's private information (address, phone number, etc.) without consent ("doxxing").
- Promotes violence or self-harm.
- Constitutes spam, phishing, malware, or unsolicited commercial advertising.
- Infringes someone else's copyright, trademark, or other intellectual property rights.
- Is unlawful in your jurisdiction or in the United States.
We may remove User Content that violates these standards and may, at our discretion, restrict or terminate the accounts of repeat offenders. Reports can be sent to info@sneakycards.com; we review safety-related reports within 24 hours.
5. Card tracking and location data
Card tracking is a core feature of the Service. When you log a GIVE or RECEIVE event you submit an approximate location (latitude / longitude, or city / state / country, as you provide it) that will be displayed publicly on the card's tracking page alongside your username. By logging an event you consent to its public display.
You can choose what level of precision to share. The Service does not collect your device's location automatically; everything is opt-in per event. You can request anonymization or removal of historical events you logged by emailing info@sneakycards.com. See the Privacy Policy for further detail.
6. Intellectual property
- The game and its missions. Sneaky Cards by Cody Borst is licensed under a Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License. You may share and adapt the missions for non-commercial purposes provided you credit Sneaky Cards and license your derivative work under the same terms.
- This website's source code. Source code released under our public GitHub repository carries its own license file; check the LICENSE in that repo for details.
- Trademarks. "Sneaky Cards", the SC logo, "#PLAYITFORWARD", and any associated word marks and logos are the property of Cody Borst. "Gamewright" and any other third-party marks belong to their respective owners. Nothing in the CC BY-NC-SA license grants you a trademark license.
- Card-maker output. PDFs you generate from the card maker are yours to print, share, and distribute non-commercially. They embed the Sneaky Cards wordmark "Make your own card at SNEAKYCARDS.COM" as a credit; please keep it intact.
7. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a takedown notice to info@sneakycards.com with the subject line "DMCA Notice". Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the allegedly infringing material on the Service, with a URL or other locator sufficient for us to find it.
- Your contact information (address, telephone, email).
- A statement that you have a good-faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Counter-notifications follow the same channel. We may forward notices to the user who posted the content. Repeat infringers will have their accounts terminated under our enforcement policy.
8. Prohibited uses
In addition to the content standards in § 4, you agree not to:
- Attempt to access another user's account or data without authorization.
- Probe, scan, or test the vulnerability of the Service except in accordance with a responsible disclosure to us first.
- Interfere with or disrupt the integrity of the Service (rate-limit evasion, denial-of-service, etc.).
- Use automated means (bots, scrapers) to collect User Content at scale.
- Reverse-engineer the Service in a way that violates applicable law.
9. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Sneaky Cards disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.
Some jurisdictions (including parts of the European Union, the United Kingdom, and certain US states) do not allow the disclaimer of certain implied warranties; in those jurisdictions, the foregoing disclaimers apply only to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Sneaky Cards or its operators be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Sneaky Cards's aggregate liability to you for any claim arising out of these Terms or your use of the Service is limited to the greater of (a) the amount you have paid to us in the twelve months preceding the claim (typically zero, since the Service is free) and (b) one hundred US dollars (USD 100).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including (in the UK) liability for death or personal injury caused by negligence and (in the EU) liability for gross negligence or intentional misconduct.
11. Enforcement, suspension, and termination
We may suspend or terminate your access to the Service, with or without notice, if (a) you materially violate these Terms, (b) we are required to do so by law, or (c) we discontinue the Service. You may terminate your account at any time from account settings. The sections of these Terms that by their nature should survive termination (intellectual property, disclaimer, limitation of liability, governing law, miscellaneous) shall survive.
12. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Sneaky Cards and its operators from any third-party claims arising out of (a) your User Content, (b) your breach of these Terms, or (c) your violation of any applicable law.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Colorado, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property rights.
If you are a consumer resident in the EU, UK, or another jurisdiction whose mandatory consumer-protection laws override the choice of law and venue above, those mandatory laws apply, and you may also bring suit in your local courts. Nothing in this section affects statutory rights you cannot waive.
14. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Sneaky Cards regarding the Service.
- Severability. If a provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, sale, or other transfer of the Service.
